General Condition of Incoming tour Operators Sicily Hotels Rental Motels and Lodging, tour packages,
selected hotels, Farm Holidays, Bed and Breakfast, Villas, Resort or Villages. Accommodation - The tipologies of accommodations reserved for our land or tour packages, selected hotels, Farm Holidays, Bed and Breakfast, Villages, and Villas all over Sicily Italy to fulfill the needs of all our customers. Hotels 5* and 4* (First Class) for exclusive holidays in the famous Sicilian cities and in the best places of the coast. 
Hotels 3* (Standard class) to make our guests live an atmosphere of comfort for relaxing stays. Exclusive Farm Houses and B&Bs located in beautiful landscapes offering a typical Sicilian hospitality and all the conveniences. Resort or Villages (first class) unique accommodations with restaurant, tennis courts, spa's, discos, sauna, swimming pool, excircise facility at your convenience, with harmoniously combine old-fashioned charm with modern comforts. Residence (high standard class) apartments in community with tennis courts, football field and playground children. Some of them with take away food, with swimming pool at your convenience, with modern comforts, usually by the sea. Houses and Villas (standard class) in the best places of the coast. 
These accommodations are clean, comfortable and located to best facilitate guided sightseeing of the area. A security deposit is required upon arrival on all Apartments and Villa’s (houses). Hotels reserved for each tourist package or tours are indicated in the Day By Day Itinerary where possible. If, for any reason, it becomes necessary to utilize other hotels, they will be of a similar or higher standard. When not, compensation will be provided. ARRIVAL AND DEPARTURE. The reserved accommodations are to disposition of the Customers beginning from the hours 12:00 of the day of arrival and check out time is 10:00 the day of departure (exceptions can be made depending on the circumstances). Possible arrivals and departures of different schedules may require statements at the time of booking or before the arrival. Why Not Inc. reserved the right to accept or less such requests. CHILDREN. Ages of Children is a must as prices may vary from one accommodation to another, but price will be included for each child once booking is requested. NUMBER OF PEOPLE IN APARTMENT AND VILLAS
You can book an accommodation for as many people as you like. Only the people who are on your confirmed booking request are authorized to reside in the accommodations, if any other person/persons are found to be residing in the facility you will be in direct violation of your contract. This will result in loss of accommodations and all monies. FLIGHTS AND RENT CARS SERVICES Some service as air transport or rental car is a contract made with the airline or rental car company through the ticketing agent, which is independent of Why not Inc.. Listed prices for cars or flights are estimates only, based on space availability, and are not guaranteed. Why Not Inc. works with various agents to secure the lowest fare available. Tickets are issued by the consolidator directly. The airlines hold a limited number of seats at the listed prices; other fares are negotiated at the time of booking to get the best possible fare. For early bookings, we may be able to negotiate a lower price. In some cases, the airlines may demand a higher deposit at the time of booking to hold your seat. Why Not inc. or its agents will inform you about this when the situation arises. Often bookings with the least amount of time may require immediate payment, in full and non-refundable, and will be issued upon receipt of such payment by check, credit card or electronic transfer. Air transportation is in economy class on scheduled airlines. AIRPORT TAXES If not collected in advance by the airline, airport taxes must be paid by the Traveler at check-in. Please call the airline in advance if unclear whether airport taxes are included in your fare. TOURIST PACKAGES DOES NOT INCLUDE Beverages, meals not detailed in the itinerary, as well as desserts and barbeque (all-you-can-eat) personal expenses including passport & visa fees, optional sightseeing tours, traditional end of the tour gratuity to your Tour Director or City/Sightseeing Guide (generally € 3-5 p.p./per day) and Driver (generally € 2-3 p.p./per day), and all other items of a personal nature. Why Not Inc. - Incoming Tour Operator, hereinafter referred to as Why Not Inc., via pascasino, 14, Marsala (TP) Italy, acts solely in the capacity of an agent for suppliers in arranging for travel-related services that are not directly supplied by Why Not Inc. (such as air and surface transportation, hotel accommodations, meals, tours, transfers, railway journeys, schooner cruises, etc.). As agent, Why Not Inc. shall not be responsible for breach of contract or any intentional or careless actions or omissions on the part of such suppliers which result in any loss, damage, delay or injury to you or your travel companions or group members. In addition, Why Not Inc. and its suppliers shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climactic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside Why Not Inc's control. Make your Reservation 
After selecting your accommodation or tourist package, simply complete and submit the APPLICATION FORM. This form is only a request of booking and not binding on your behalf. 
We will contact you by E-mail or Fax with availability, prices and conditions within 48 hours. If you desire to make a reservation with us, please reply ASAP because reservation are made on a first come first serve basics. To make your booking a deposit and a small resgistration fee of € 36,00 is required. You will receive an e-mail or fax as receipt of your payment. After we receive the total amount we will send definite confirmation of your booking by e-mail or fax. In case of a Tourist Package you will receive our Voucher. Final payment for definite confirmation of your booking is due 30 days in advance of your arrival. These payments are preferred by credit card (Visa, Mastercard) Traveler's cheque, Bank Draft or Money Orders. A copy of the payment transaction is riquired on money orders, travelers cheque and bank draft, and can be submitted via fax or on-line and are due in our office or submitted online 30 days prior to the departure date. If reservations are made less than 30 days prior to departure, payment in full is required at the time of booking. If final payments are not received on time, Why Not Inc. cancel the reservation and invoke the cancellation fee. Deposit and Registration Fee - Deposits are generally 30% of the total accomodation or land package price. A higher deposit may be required for customized itineraries or for securing special flight arrangements. Registration fee guarantees you our complete support 24 hrs 7 days a week during your stay in Sicily as well as our administrative cost. Cancellations, Changes & Refunds. If a cancellation in writing is received by Why Not Inc. not less than 60 days before departure, your deposit will be refunded, less € 36,00 per person service fee. In the case of Car Rental, if the recess is received not less than 60 days before the departure, the total amount will be refunded, less euros 100,00 service fee to coverage of the expenses of booking and technical organization. If you must withdraw 60 days or less prior to departure, the following fees will apply, excluded the Registration fee: 60 Days to 45 Days prior to departure 20% of total (min. € 100)
45 Days to 31 Days: prior to departure 35% of total
30 Days to 15 Days: prior to departure 50% of total
14 Days to Day of Departure: 100% of total No refund is due after such time. No refund is due if you decide to interrupt the trip already undertaken, or for personal documents reasons. 
In case of inherent changes of the effected booking, required by the customer, Why Not Inc. reserved the right to accept or less the type of change. Additionally, € 175 or more may be assessed for changes in air travel bookings after tickets have been issued, in accordance with the airline’s and issuer’s change and cancellation policies, and depending on the booking class of the ticket. Fee assessments and changes are the responsibility of the ticketing agent and airlines. Non-refundable items (ie Carnival, High season and New Year's deposits) are excluded from the refund policy. For others changes, required by the customer, Why Not inc. has the right to accept or less whatever variation. In case of change the expenses will be Euro 50,00 for every variation debited to the customer. To protect yourself against unforeseen circumstances, we recommend to purchase a Travel Insurance. PAYMENT METHODS - Choose the method of payment that you prefer, clicking on the link to see our different “payment methods”, that will find in the menù on the left or in the bar. Traveler assumes complete and full responsibility for, and hereby releases Why Not inc. and its suppliers from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department. For medical information and requirements, contact the Public Health Service. For tax information and holiday/museum schedules contact the respective tourist office. In case of dysfunctions e/o unexpected fact, we ask you to contact us during the stay with the purpose to allow us an intervention the more timely possible to solution of the unforeseen event. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of such risks and is advised to obtain appropriate insurance coverage against them. Why Not Inc. reserves the right to withdraw any tour or to make any change in the land package, with or without notice, that Why Not Inc. determines is advisable, including substitution of accommodations or transportation. If any tour or tourist package must be withdrawn prior to its beginning date, Why Not Inc's liability is limited to a refund of monies, if any, received by Why Not Inc. for services not provided. Further, Why Not Inc. may decline to accept or retain any person on the tour at anytime. Should a passenger's conduct become incompatible with the smooth operation of the tour or adversely affect the safety and enjoyment of the other passengers, then the tour membership will be withdrawn and Why Not Inc. shall be under no liability to such person. Passenger's enrollment and payment for a tour shall constitute the passenger's offer to take the tour pursuant to all of the terms set forth above and in our online catalog, which terms cannot be varied except in writing by an officer of Why Not Inc.. A binding contract shall exist only after Why Not Inc. has accepted the offer by sending a confirmation to the passenger, either in written or electronic form. If there is any dispute between the passenger and Why Not inc., the parties will submit to mediation by a mediator chosen by both parties and, if not resolved by mediation, then by binding arbitration by one arbitrator chosen by the parties, or if no choice can be made, then by an arbitrator chosen by a judge of the State of Italy. All proceedings shall occur in Italy, and Italian law shall apply. The passenger agrees to this exclusive jurisdiction and venue in Italy for resolving all disputes. Why Not inc. strives to arrange all services to the traveler’s expectations. Should a service supplier not deliver to the traveler’s expectations, Why Not inc. and the service supplier must be notified immediately as to allow for the opportunity to remedy the situation. Should the situation not change to the traveler’s satisfaction, Why Not inc. must receive notification of the dispute in writing (e-mail or fax) within 24 hours. Transportation companies, airlines, etc., are not to be held responsible for any act, omission or event during the time passengers are not on board planes, transportation or conveyances. The passenger contracts in use by the airlines or transportation companies when used shall constitute the sole contract between the airline, transportation company and passenger or purchaser of this land package or tour and Why Not inc. assumes no responsibility in this connection.
